Please read these Terms of Service ("Terms") carefully before using Vision Anatomy. By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Agreement to Terms
By accessing or using Vision Anatomy ("the Service"), operated by MySegmenter Technologies Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.
You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to use this Service, and you must meet the minimum age and account requirements set by Meta for Meta Quest devices and Meta Horizon accounts. By using the Service, you represent that you meet these requirements.
If you are using the Service on behalf of an institution (e.g., a university or hospital), you represent that you have authority to bind that institution to these Terms, and "you" refers to both you individually and the institution.
2. Description of Service
Vision Anatomy is an educational mixed-reality (MR) software application for Meta Quest head-mounted displays that renders interactive, anatomically-accurate 3D models of human anatomy for exploration by region and by anatomical system. The Service is a visualization and learning aid for education, training, and reference purposes.
Vision Anatomy is NOT a medical device. It has not been cleared or approved by the FDA or any other regulatory authority, and it is not classified or marketed as a diagnostic, treatment-planning, or clinical decision-support tool. The intended patient population is not applicable in a diagnostic sense: the Service does not acquire, process, or display data from any real patient, and all anatomical content is generalized, model-based reference material.
The Service is intended for medical and allied-health students, anatomy educators and their classes, and qualified healthcare professionals using the tool for self-study, teaching, or pre-procedure familiarization. Access is gated by a per-device software license.
3. Account Terms
To access the Service, you must sign in, and your access is validated against a per-device software license before the anatomy experience opens. When creating or using an account, you agree to:

Provide accurate, current, and complete information.

Keep your login credentials and license key secure and confidential.

Accept responsibility for all activity that occurs under your account or license.

Notify us immediately of any unauthorized use of your account or license.
You may not share your account credentials or license key or allow others to access your account. We reserve the right to suspend or terminate accounts or licenses that violate these Terms.
4. License & Usage Rights
Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable, device-bound license to install and use the Service on the number of Meta Quest headsets specified in your license.
You may:

Install and use the Service on the headset(s) authorized under your license.

Use the Service for personal education, training, self-study, or, where separately licensed, institutional teaching.

View, isolate, and interact with the anatomical models and reference content provided within the app.
You may not:

Copy, modify, or distribute the software without authorization.

Reverse engineer, decompile, or disassemble the software, including the license validation mechanism.

Circumvent, tamper with, or attempt to defeat device-bound license validation (Keygen) or hardware binding.

Remove or alter any proprietary notices or labels.
-
Sublicense, rent, lease, lend, or share the software or your license key with third parties.

Extract, copy, or reuse the underlying 3D anatomical models (including licensed third-party content) outside the Service.

Use the Service to develop a competing product.

Exceed the number of licensed devices specified in your license.
5. Health & Safety Warnings (Mixed-Reality Use)
As a head-mounted mixed-reality application, standard XR-device precautions apply, in addition to Meta's own headset health and safety warnings, which continue to govern your use of the Device:

Do not use the Service if you have a history of photosensitive seizures or epilepsy.

If you are pregnant, elderly, sleep-deprived, or under the influence of alcohol, consult a medical professional before use.

The Service may cause motion sickness, dizziness, or disorientation in some users. Discontinue use immediately if you experience any of these symptoms.

Use the Service only in a safe, clear physical area appropriate for headset use, following the Device manufacturer's guidance (e.g., Guardian boundary).

The Service follows the Headset Platform's minimum age guidance and is not intended for young children.
You use the Service at your own risk. The Company is not responsible for injuries arising from failure to follow these warnings or Meta's headset safety instructions.
6. Educational Use Only — Not a Medical Device
Vision Anatomy must not be used for diagnosis, treatment planning, intra-operative guidance, or any clinical decision-making about a specific real patient. Its content is generalized reference material and is not patient-specific.

The Service is an educational aid, not a substitute for accredited medical training, certification, or clinical judgment.

All anatomical information should be verified against authoritative, current medical literature and by qualified instructors before being relied upon in any professional context.

The Service must not be used as the basis for patient care decisions.

Users remain solely responsible for ensuring appropriate use of the Service consistent with their professional and educational obligations.
7. Acceptable Use Policy
You agree to use the Service only for lawful, intended educational purposes. You agree not to:

Use the Service in violation of any applicable law or regulation.

Attempt to gain unauthorized access to the Service, license servers, or related systems.

Interfere with or disrupt the integrity or performance of the Service.

Introduce viruses, malware, or other harmful code.
-
Use automated systems to access the Service without permission.
-
Impersonate any person or entity.
-
Use the Service for any purpose other than its intended educational/reference use.
8. Intellectual Property
Our Property
The Service, including its software, UI, design, and original content, is owned by MySegmenter Technologies Inc. and protected by copyright, trademark, and other intellectual property laws. "Vision Anatomy" and associated marks are trademarks of MySegmenter Technologies Inc..
Third-Party Licensed Content
Certain anatomical 3D models and reference datasets are licensed from third parties (e.g., Zygote) and remain the property of those licensors. Your use of this content is limited to viewing it within the Service and is subject to the applicable third-party license restrictions; you may not extract or reuse it outside the Service.
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution to you.
9. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Service does not process Protected Health Information (PHI) or data about real patients, and HIPAA does not apply to the Service's ordinary operation. If somehow your institution independently uses the Service in a way that involves PHI, you are solely responsible for ensuring compliance with applicable healthcare privacy laws.
10. Payment Terms
The Service is distributed and sold through the Meta Horizon (Quest) Store. Pricing, billing, currency, taxes, and refunds for your purchase are governed by Meta's own store terms and policies. The Company does not directly process or store your payment card information.
If the Company separately offers institutional licenses purchased directly (outside the Meta Store), those purchases will be governed by a separate order form or invoice, and fees will be as stated there. Except as required by law or expressly stated, fees are non-refundable.
11. Third-Party Platform Terms (Meta)
Your use of the Service on a Meta Quest headset is also subject to Meta's own Terms of Service, Meta Horizon Store terms, and Meta's Privacy Policy, which govern the headset, your Meta/Meta Horizon account, and the store through which the Service was obtained. In the event of a conflict between these Terms and Meta's terms regarding the underlying platform, Meta's terms will govern platform-level matters, and these Terms will govern the Service itself.
12. Termination
By You
You may stop using the Service and uninstall it at any time, and may request deactivation of your license by contacting us.
By Us
We may suspend or terminate your access to the Service, without prior notice, if:

You breach any provision of these Terms.

We reasonably believe your license is being used fraudulently or in a manner that circumvents device binding.

We are required to do so by law.

We reasonably believe your use poses a security risk.
Effect of Termination

Your right to use the Service immediately ceases and your license is deactivated.

Provisions that by their nature should survive termination will survive (e.g., IP, disclaimers, indemnification, governing law).
13. Disclaimers & Warranties
We do not warrant that:

The Service will be uninterrupted, secure, or potentially error-free.
-
The anatomical content is complete, exhaustive, or a substitute for accredited medical education or professional judgment.

The Service will meet your specific requirements.

Any defects will be corrected.
Hardware-related warranties for the Meta Quest headset itself are the responsibility of Meta, not the Company.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSEGMENTER TECHNOLOGIES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING ANY PHYSICAL DISCOMFORT OR INJURY ARISING FROM MIXED-REALITY HEADSET USE WHERE THE WARNINGS IN SECTION 5 WERE NOT FOLLOWED.
Our total liability for any claim under these Terms shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless MySegmenter Technologies Inc., its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with:

Your access to or use of the Service.

Your violation of these Terms, including the license restrictions in Section 4.

Your violation of any third-party rights, including intellectual property rights in licensed anatomical content.

Your violation of any applicable laws or regulations.

Any use of the Service for clinical decision-making contrary to Section 6.
15. Governing Law
This Privacy Policy is governed by the laws of the Republic of India, without regard to its conflict-of-law provisions. For users in the European Union, this choice of law does not deprive you of protections that cannot be derogated from under the law of your country of residence.
Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (or the equivalent body in the governing jurisdiction).
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action, to the extent permitted by law.
16. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting updated Terms, updating the Effective Date, and, for significant changes, notifying registered users by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
